Please read these Terms and Conditions (“Terms”) carefully before accessing or using Skins.com. These Terms constitute a legally binding agreement between You and the operators of Skins.com. By registering an account or otherwise using any part of the Service, You confirm that You have read, understood and accept these Terms, together with our Privacy Policy. If You do not agree to these Terms, You must not use the Service.
DEFINITIONS
You/User means any individual aged at least 18, or the age of majority in their jurisdiction (whichever is higher), who accesses or uses the Services. A User acts as a “Buyer” when purchasing a digital item and as a “Supplier” when selling a digital item.
We/Us/Our means Skins.com as owned and operated by 99 HP Tech Limited, a company incorporated under the laws of Hong Kong, bearing company registration number 78013908, and maintaining its principal place of business at Unit 2904-05, 29/F, Universal Trade Centre, No.3 Arbuthnot Road, Central, Hong Kong. The Company may use as its payment agent for certain payments, Flyberry Ltd, a company incorporated in Cyprus, bearing company registration number HE495068, and registered address at Agias Elenis 4, MICHAELIDES BUILDING, 1st floor, Flat/Office 104, 1060 Nicosia, Cyprus.
99 HP Tech Limited provides to Users the platform technology, user interface, operational infrastructure, platform operations, security and compliance oversight. 99 HP Tech Limited does not receive any User funds and does not buy or sell any item from or to Users.
Skins.com means the digital marketplace operated at Skins.com, through which Users may buy and sell CS:GO and CS2 digital items. The addition of further games or item types shall not require any amendments to these Terms.
Marketplace means the listing-based service through which a Supplier’s item is matched to a Buyer and delivered by a third-party provider (e.g. Steam) trade offer.
Instant Sale/Instant Buy means the service through which a User buys or sells an item at a quoted price, routed by the platform to a connected marketplace or trader.
Buy Order means a standing instruction to acquire a specified item at or below a specified price.
Skins Pro means the advanced interface made available to eligible Users, providing enhanced tools for listing, buying and selling items.
Skins Extension means the browser extension provided by Us to assist Users in sending and confirming third-party provider trade offers.
Services means all activities carried out by Us through Skins.com in connection with the purchase and sale of digital items.
Virtual Items/Skins means the digital, in-game cosmetic items existing within a third-party game environment. Virtual items are not currency, securities, or financial instruments and confer no rights outside the relevant game. Reference to buying or selling a Virtual Item means the transfer of that item between third-party provider accounts and does not transfer any right in the underlying game.
Skins.com provides an online marketplace through which Users may buy and sell CS2 digital items.
Skins.com is operated by Us. We provides to Users the platform technology, user interface, operational infrastructure, platform operations, security and compliance oversight. We do not receive any User funds and do not buy or sell any item from or to Users. Payments are processed by Our payments agent. The Marketplace is offered at 0% commission, and any applicable fees are displayed on the platform before a transaction is completed.
1.1. Products
The Services comprise the Marketplace, Instant Sale and Instant Buy, Buy Orders, and Skins Pro.
1.2. The Skins Extension
Certain transactions require the Skins Extensions in order to send and confirm third-party provider trade offers. By installing the Skins Extension, You authorise it to assist with trade offers associated with Your account. You remain solely responsible for maintaining the security of Your third-party provider account and its eligibility to send and receive items. We shall not be liable for any consequences arising from Your third-party provider account settings or from any trade restrictions imposed by a third-party provider.
1.3. Platform Operator
All intellectual property rights in Skins.com , including but not limited to its software, branding and domain, are owned by Us or Our licensors. We are responsible for the technical operation and availability of the platform.
2.1. Eligibility
In order to register to use the Services, You must: (a) be at least 18 (eighteen) years of age, or the age of majority in Your jurisdiction, whichever is higher, (b) provide accurate, current and complete registration information, and (c) maintain confidentiality and security of Your account credentials. We reserve the right to restrict, suspend or terminate any account where required for legal, regulatory or operational reasons.
2.2. Verification
Verification is required in order to transact. Further identity verification may be required prior to payout, or in connection with higher transaction volumes. Prior to a Supplier’s first sale, the Supplier must declare whether they are acting as an individual or as a business. This declaration is required for the purposes of applicable reporting obligation, including but not limited to DAC7, taxation, and account verification. The User is solely responsible for the accuracy of the information provided.
We may request verification information or documentation at any time, and may restrict an account, withhold payout, or place funds or items on hold pending completion of such verification or any related review. Where verification is not completed, We may decline or reverse the relevant transaction.
2.3. Inactive Accounts
Where an account remains inactive for a period of 12 months, We reserve the right to list the items held in that account for sale at the prevailing market price, where a sale is not possible, to remove the item. We shall provide the User with no fewer than 28 days’ notice before such action is taken.
2.4. The Service is not available to, and may not be used by, any person located in, ordinarily resident in, or accessing the Service from United States of America, any jurisdiction subject to comprehensive sanctions, including without limitation North Korea, Iran, Cuba, Syria, Russia, Belarus, and the Crimea, Donetsk and Luhansk regions of Ukraine, or any territory restricted by Our payment or settlement providers or by applicable law. We reserve the right to add to or amend the list at any time. Any attempt to access the Service from a restricted territory, or to circumvent geographic controls, is strictly prohibited and may result in closure of the account.
3.1. Listing Items
A Supplier may list eligible items on the Marketplace. By listing an item, the Supplier warrants that it has full right and title to sell the item and that the item is not stolen, unlawfully obtained, or one the Supplier is not entitled to sell. We reserve the right to reject, remove or amend any listing at Our discretion.
3.2. Formation of a Transaction
Where a listed item is matched to a Buyer, the Buyer acquires the item through the platform at the listed price.
3.3. Delivery
Items are delivered by a third-party provider trade offer (e.g. Steam). Once a transaction has been matched, the Supplier must (a) accept the matched transaction and send the corresponding third-party provider trade offer using the Skins Extension. By reason of the hold period applied by a third-party provider, an item may be subject to a hold of up to 7 days before it becomes available, and an item within a third-party provider trade-lock or reversal period may not be listed or made available for purchase until that period has ended. Delivery is complete once the item appears in the Buyer’s third-party provider inventory. We shall not be liable for any delay, trade-lock, reversal or restriction caused by a third-party provider or arising from the configuration of a User’s third-party provider account.
You are responsible for keeping Your third-party provider account in a state eligible for trading, including but not limited to maintaining the Steam Guard Mobile Authenticator for the period required by Steam. We may decline, delay or cancel a transaction where a third-party provider account is subject to restrictions or present a security or fraud risk.
3.4. Non-Completion Charges
The completion of a matched transaction forms part of each User's obligation. Where a Supplier or Buyer fails to complete a matched transaction, We may apply a non-completion service charge at rates notified within the platform. Repeated non-completion may result in the restriction or suspension of the account.
3.5. Purchases
Purchases are completed through the platform. Prices may be inclusive of VAT depending upon the User’s location. We reserve the right to cancel any transaction which We reasonably believe to involve misuse of the platform or a breach of the Terms.
3.6. Finality of Transactions
Completed transactions are final. As the Services concern digital items delivered without delay, You are not entitled to cancel or reverse a completed transaction. You agree not to initiate any chargeback, payment reversal or dispute with a card issuer. Payment provider or Steam in respect of a transaction properly completed under these Terms. Doing so is a breach of these Terms and may result in suspension of the account and recovery of the amounts concerned, together with associated costs.
Instant Sale enables a User to sell an item immediately at the quoted price. Instant Buy enables a User to purchase an item immediately at the price quoted, with delivery completed automatically within seconds. In each case the transaction is routed by the platform to a connected marketplace or a trader operating through Skins Pro. Quoted prices reflect the prevailing market conditions and are confirmed to the User before the transaction is completed. All other provisions of these Terms apply to instant transactions.
A Buy Order constitutes a standing instruction to acquire a specified item at or below a price determined by the User. A Buy Order may be matched when a corresponding listing becomes available, and may be cancelled by the User at any time prior to matching. A User must hold sufficient balance in order for a Buy Order to be eligible for matching. Buy Orders may be subject to expiry or to such limits as are notified within the interface.
Skins Pro is an advanced interface, made available to eligible Users, providing enhanced tools for listing, buying and selling items. Skins Pro is subject to these Terms and to any additional requirement notified within the interface. The use of automation tools provided by Us within Skins Pro is permitted, all other forms of automated access remain prohibited under section 10. All purchases and sales effected through Skins Pro follow the same legal structure as other Marketplace transactions.
A User may add funds to their balance using fiat currency or any supported cryptocurrency. All balances are displayed in USD. Where funds are added in cryptocurrency, the USD equivalent is calculated at the time the funds are added.
Where instant processing is available, the term “instant” refers to accelerated processing initiated immediately upon request. Actual processing times may vary, and instant availability is not guaranteed. The addition of funds does not constitute credit or an advance of funds.
8.1. Supplier payouts
Supplier payouts are processed 7 days following confirmed delivery of the item to a Buyer in order to allow the transaction to be confirmed and any related matter to be addressed. We reserve the right to extend this period in respect of high-value items, newly created accounts, or any transaction under review.
8.2. Instant Payouts
Where instant payout processing is available, requests are processed on an accelerated basis. Instant processing is not guaranteed and may be subject to verification or delay.
8.3. Nature of payouts
A payout represents the remittance to a Supplier of a sale process owed in respect of completed transactions, processed by Our payments agent. Payouts are not escrowed funds, custodial holdings, or User-held deposits. A balance is otherwise applied towards purchases on Skins.com.
The Marketplace operates at 0% commission. We may levy fees in respect of particular services, including instant processing and the non-completion charges (section 3.4). Any applicable fees are displayed to the User before the relevant transaction is confirmed. Prices may be inclusive of VAT. Any change to fees is notified in section 20. Fees and charges paid to Us are non-refundable. A refund of a purchase, where applicable, is returned to the original method of payment.
Skins.com depends on the fair and lawful conduct of its Users. Accordingly, You agree that You will not:
list or sell any item that is stolen, unlawfully obtained or that You are not entitled to sell;
use the Service to engage in any fraudulent or deceptive activity;
Misuse the payment or refund process;
Use bots, scrapers or other automated tools, save for those We provide or expressly permit;
Circumvent any geographic restriction or account-verification measure;
Interfere with the operation, security or infrastructure or the platform; or
Breach the rules of any connected third-party platform, including but not limited to Steam.
Where a User does not comply with this section 10, We may suspend or close the relevant account, cancel any affected transaction, or pursue any other remedy available to Us.
A Buyer should report any issue within 7 days of the relevant transaction. A Supplier may dispute a payout decision by contacting support. Flyberry Ltd, as a payment agent, is responsible for the transaction disputes and refund decisions and may, where appropriate, reverse a transaction or issue a refund at its sole discretion. The User shall cooperate with any reasonable request for information made in connection with the resolution of a dispute.
Skins.com operates in conjunction with third-party services, such as Steam, payment providers and identity verification providers. We shall not be responsible for any outage, policy change or action taken by such a service. Restrictions or technical limitations imposed by third party providers are outside of Our control. Skins.com is operated independently and is not affiliated with, endorsed by, or sponsored by Valve Corporation, CS:GO, CS2 and Steam are trademarks of their respective owners.
13.1. We reserve the right to modify, suspend or discontinue any part of the Service at any time. We shall not be liable for any interruption to the Service, save that We remain responsible for the repayment of any outstanding balance owed to a User.
13.2. We shall not be liable for any failure or delay in performance caused by events beyond Our reasonable control, including the acts or outages of Steam or other third parties, network or infrastructure failures, regulatory action, or any event of force majeure.
14.1. To the maximum extent permitted by law, We shall not be liable for any indirect or consequential loss, loss of profit, loss of data, failure of any third-party platform, or loss arising from the User’s own acts and omissions.
14.2. To the maximum extent permitted by law, Our total aggregate liability to a User shall be the greater of USD 100 or the total fees paid by that User during the preceding 12 months. This limitation does not apply to any outstanding balance owed to the User.
14.3. The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, We make no warranty that the Service will be uninterrupted, error-free or secure, and We are not liable for any loss arising from Steam or other third-party platform, from hardware, software or internet failures, or from any unathorised use of Your account by a person using Your credentials.
The User shall indemnify Us against any claim, loss or cost arising from the User’s breach of these Terms, any unlawful conduct by the User, or any misuse of the User’s Steam or third-party account.
These Terms are governed by the laws of Hong Kong SAR. Before commencing formal proceedings, the parties shall first attempt in good faith to resolve any dispute through negotiation for a period of at least 30 days following written notice. Any dispute not resolved within that period shall be subject to the exclusive jurisdiction of the courts of the Hong Kong SAR.
We process personal data in accordance with applicable data protection laws, including EU General Data Protection regulation (GDPR) where applicable. Our collection and use of personal data is described in Our Privacy Policy, which forms part of these Terms and is available on the platform. We process personal data for the purposes of providing the Services, verifying identity, complying with legal and regulatory obligation, and preventing fraud and abuse.
Should You wish to make a complaint, You may contact Us using the details set out in section 21. We shall acknowledge and seek to resolve complaints within a reasonable period. Nothing in these Terms affects any mandatory rights You may have under the consumer protection law of Your country of residence.
You may close Your account at any time. We may close or suspend an account in accordance with these Terms, including in the event of breach, suspected fraud, or for regulatory reasons. Upon closure, and remaining balance shall be dealt with in accordance with section 8 and applicable law, subject to any verification We are required to undertake. When an account shows no activity for a period of 12 months, We may apply a dormancy process, including taking reasonable steps to contact You and to deal with any remaining balance in accordance with applicable law.
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Any changes take effect as soon as they are published on the Website. We recommend that you review the Terms regularly to stay informed. If we make any material changes that significantly impact your rights or obligations, we will provide notice where required by law. If you continue to use the Services after changes are published, you are considered to have accepted the updated Terms. If you do not agree to the revised Terms, you must stop using the Services. These Terms are published in English and may be translated into other languages. In the event of any conflict between the English language version and a translated version, the English version shall prevail.
