THE SERVICES

Skins.com provides an online marketplace through which Users may buy and sell CS2 digital items.

Skins.com is operated by Us. We provides to Users the platform technology, user interface, operational infrastructure, platform operations, security and compliance oversight. We do not receive any User funds and do not buy or sell any item from or to Users. Payments are processed by Our payments agent. The Marketplace is offered at 0% commission, and any applicable fees are displayed on the platform before a transaction is completed.

1.1. Products

The Services comprise the Marketplace, Instant Sale and Instant Buy, Buy Orders, and Skins Pro.

1.2. The Skins Extension

Certain transactions require the Skins Extensions in order to send and confirm third-party provider trade offers. By installing the Skins Extension, You authorise it to assist with trade offers associated with Your account. You remain solely responsible for maintaining the security of Your third-party provider account and its eligibility to send and receive items. We shall not be liable for any consequences arising from Your third-party provider account settings or from any trade restrictions imposed by a third-party provider.

1.3. Platform Operator

All intellectual property rights in Skins.com , including but not limited to its software, branding and domain, are owned by Us or Our licensors. We are responsible for the technical operation and availability of the platform.

2. ELIGIBILITY AND REGISTRATION

2.1. Eligibility

In order to register to use the Services, You must: (a) be at least 18 (eighteen) years of age, or the age of majority in Your jurisdiction, whichever is higher, (b) provide accurate, current and complete registration information, and (c) maintain confidentiality and security of Your account credentials. We reserve the right to restrict, suspend or terminate any account where required for legal, regulatory or operational reasons.

2.2. Verification

Verification is required in order to transact. Further identity verification may be required prior to payout, or in connection with higher transaction volumes. Prior to a Supplier’s first sale, the Supplier must declare whether they are acting as an individual or as a business. This declaration is required for the purposes of applicable reporting obligation, including but not limited to DAC7, taxation, and account verification. The User is solely responsible for the accuracy of the information provided.

We may request verification information or documentation at any time, and may restrict an account, withhold payout, or place funds or items on hold pending completion of such verification or any related review. Where verification is not completed, We may decline or reverse the relevant transaction.

2.3. Inactive Accounts

Where an account remains inactive for a period of 12 months, We reserve the right to list the items held in that account for sale at the prevailing market price, where a sale is not possible, to remove the item. We shall provide the User with no fewer than 28 days’ notice before such action is taken.

2.4. The Service is not available to, and may not be used by, any person located in, ordinarily resident in, or accessing the Service from United States of America, any jurisdiction subject to comprehensive sanctions, including without limitation North Korea, Iran, Cuba, Syria, Russia, Belarus, and the Crimea, Donetsk and Luhansk regions of Ukraine, or any territory restricted by Our payment or settlement providers or by applicable law. We reserve the right to add to or amend the list at any time. Any attempt to access the Service from a restricted territory, or to circumvent geographic controls, is strictly prohibited and may result in closure of the account.

3. THE MARKETPLACE

3.1. Listing Items

A Supplier may list eligible items on the Marketplace. By listing an item, the Supplier warrants that it has full right and title to sell the item and that the item is not stolen, unlawfully obtained, or one the Supplier is not entitled to sell. We reserve the right to reject, remove or amend any listing at Our discretion.

3.2. Formation of a Transaction

Where a listed item is matched to a Buyer, the Buyer acquires the item through the platform at the listed price.

3.3. Delivery

Items are delivered by a third-party provider trade offer (e.g. Steam). Once a transaction has been matched, the Supplier must (a) accept the matched transaction and send the corresponding third-party provider trade offer using the Skins Extension. By reason of the hold period applied by a third-party provider, an item may be subject to a hold of up to 7 days before it becomes available, and an item within a third-party provider trade-lock or reversal period may not be listed or made available for purchase until that period has ended. Delivery is complete once the item appears in the Buyer’s third-party provider inventory. We shall not be liable for any delay, trade-lock, reversal or restriction caused by a third-party provider or arising from the configuration of a User’s third-party provider account. Where delivery cannot be completed, the Buyer is entitled to a full refund in accordance with Our Refund Policy.

You are responsible for keeping Your third-party provider account in a state eligible for trading, including but not limited to maintaining the Steam Guard Mobile Authenticator for the period required by Steam. We may decline, delay or cancel a transaction where a third-party provider account is subject to restrictions or present a security or fraud risk.

3.4. Non-Completion Charges

The completion of a matched transaction forms part of each User's obligation. Where a Supplier or Buyer fails to complete a matched transaction, We may apply a non-completion service charge at rates notified within the platform. Repeated non-completion may result in the restriction or suspension of the account.

3.5. Purchases

Purchases are completed through the platform. Prices may be inclusive of VAT depending upon the User’s location. We reserve the right to cancel any transaction which We reasonably believe to involve misuse of the platform or a breach of the Terms.

3.6. Finality of Transactions

As the Services concern digital items delivered without undue delay, completed transactions are final once the item has been delivered to Your third-party provider account, save where a refund is available under Our Refund Policy or under applicable law.

This does not affect Your right to raise a dispute with Your card issuer, payment provider or Steam, or Your mandatory rights as a consumer. We ask that You contact Our support team first, so that We can resolve the matter directly — in most cases faster than a payment dispute, which typically takes several weeks.

4. INSTANT SALE AND BUY

Instant Sale enables a User to sell an item immediately at the quoted price. Instant Buy enables a User to purchase an item immediately at the price quoted, with delivery completed automatically within seconds. In each case the transaction is routed by the platform to a connected marketplace or a trader operating through Skins Pro. Quoted prices reflect the prevailing market conditions and are confirmed to the User before the transaction is completed. All other provisions of these Terms apply to instant transactions.

5. BUY ORDERS

A Buy Order constitutes a standing instruction to acquire a specified item at or below a price determined by the User. A Buy Order may be matched when a corresponding listing becomes available, and may be cancelled by the User at any time prior to matching. A User must hold sufficient balance in order for a Buy Order to be eligible for matching. Buy Orders may be subject to expiry or to such limits as are notified within the interface.

6. SKINS PRO

Skins Pro is an advanced interface, made available to eligible Users, providing enhanced tools for listing, buying and selling items. Skins Pro is subject to these Terms and to any additional requirement notified within the interface. The use of automation tools provided by Us within Skins Pro is permitted, all other forms of automated access remain prohibited under section 11. All purchases and sales effected through Skins Pro follow the same legal structure as other Marketplace transactions.

Skins Pro is an interface to the same Service, operated by the same entity, and is accessed using the same account. A User has a single balance, which is common to Skins.com and to Skins Pro. Funds are not held separately for, or allocated between, the two interfaces, and sections 8 and 9 apply identically however the Service is accessed.

7. PARTNER PRODUCTS AND INTEGRATED SERVICES

The Service may allow Users to access products, features or services provided by third-party partners or affiliated service providers (“Partner Products”).

Partner Products may be accessed through the User’s existing account, and may use integrated registration, authentication, wallet, balance-display and other technical functionalities intended to provide a seamless User experience.

By accessing or using a Partner Product, the User:

requests and authorises Us to create, connect or facilitate access to an account for the relevant Partner Product;
agrees that the User’s account, identification and technical data may be shared with the relevant partner to the extent necessary to provide access to and operate the Partner Product;
agrees that their Skins.com balance and related transaction information may be displayed within the Partner Product, and that the User may transfer funds between their Skins.com balance and the Partner Product, in each case through Our integrated infrastructure;
acknowledges that where the User transfers funds from their Skins.com balance to a Partner Product, or receives funds from a Partner Product into their Skins.com balance, that transfer constitutes a payout or an addition of funds under these Terms and is subject to sections 8 and 9 in the same way as any other payout or addition of funds, including the spend condition in section 8.3 and the payout provisions in section 9;
acknowledges that each Partner Product may be operated by a separate legal entity and may be subject to additional terms, policies, restrictions and eligibility requirements.

The User’s decision to select, open or use a Partner Product constitutes the User’s express consent to the account, data and balance-transfer integration described in this section.

7.1. Balances held within a Partner Product

Any balance held within a Partner Product is issued, held and managed exclusively by the operator of that Partner Product, under that operator’s own terms. We do not hold, control or administer any Partner Product balance, and We are not responsible for its availability, value or use. A balance held within a Partner Product does not form part of Your Skins.com balance, and any right You have in respect of it is against the operator of that Partner Product.

Funds cease to form part of Your Skins.com balance at the point they are transferred to a Partner Product, and form part of Your Skins.com balance only once received from the Partner Product. Where a Partner Product balance is displayed within Our interface, that display is for convenience only and does not alter this position.

7.2. Partner Product operators and responsibility

Further information regarding the operators of individual Partner Products, their applicable terms and relevant contact details is available through the applicable Partner Product’s own policy or service notice.

We shall not be responsible for the operation, availability, content or performance of any Partner Product, except to the extent expressly stated in the applicable Partner Product’s documentation. Nothing in this section limits or excludes any liability which cannot lawfully be limited or excluded, or affects any mandatory right You have as a consumer.

8. ADDING FUNDS

8.1. Adding funds

A User may add funds to their balance using fiat currency or any supported cryptocurrency. All balances are displayed in USD. Where funds are added in cryptocurrency, the USD equivalent is calculated at the time the funds are added.

Where instant processing is available, the term “instant” refers to accelerated processing initiated immediately upon request. Actual processing times may vary, and instant availability is not guaranteed. The addition of funds does not constitute credit or an advance of funds.

8.2. Purpose of added funds

Funds are added to a balance for the sole purpose of purchasing items on Skins.com. Added funds are not a deposit, are not held by Us or by Our payments agent on Your behalf, and are not withdrawable.

8.3. Spend condition

Before a payout may be requested, an amount at least equal to the total fiat funds You have added to Your balance must have been applied to the purchase of items on Skins.com. We maintain for each account a running record of the fiat funds added and of the amounts applied to purchases, and the amount which remains to be applied before a payout may be requested is displayed to You within the withdrawal interface.

Until that condition is satisfied, Your balance may be applied to the purchase of items, and any item You purchase may be withdrawn to Your third-party provider account without restriction, but no part of Your balance may be paid out to You in fiat currency or in cryptocurrency, or transferred to a Partner Product under section 7.

This section does not apply to the proceeds of a completed sale, which are dealt with under section 9. Nothing in this section affects any refund due under Our Refund Policy or under applicable law, any mandatory right You have as a consumer, Your right to raise a dispute with Your card issuer or payment provider, or Your right to the return of unspent added funds on closure of Your account under section 20.

8.4. Stored payment credentials and one-click payments

8.4.1. Your consent

Your card details are stored only where You expressly consent to it. At checkout You must manually tick the box confirming that You have read and accept this section 8.4 and agree to the storage of Your payment credentials for use in future transactions. Consent is not a condition of using the Service: You may add funds on a one-off basis without storing Your card details, and all Services remain available to You if You do not consent. Consent may be withdrawn at any time in accordance with section 8.5.

8.4.2. What is stored, and where

We do not store, and We do not have access to, Your full card number, expiry date or card security code (CVV/CVC). Where You consent, Your card details are transmitted directly to Our payment service providers and stored by them in tokenised form within their own PCI DSS compliant environment. We receive only a Stored Credential — a token reference which cannot be used to reconstruct Your card details — together with the card scheme, the last four digits of the card number and the expiry date, so that You are able to identify the card within Your account. A Stored Credential may be used only to initiate payments to Skins.com and has no value or use elsewhere. Further detail on the processing of this data is set out in Our Privacy Policy.

8.4.3. How a Stored Credential is used

A Stored Credential is used solely to process payments which You initiate, being the addition of funds to Your balance where You select the saved card and confirm the payment. We do not use a Stored Credential for recurring, subscription, unscheduled or merchant-initiated payments, and Your card will not be charged without Your action. Each payment remains subject to the authentication requirements of Your card issuer, including Strong Customer Authentication where applicable.

8.5. Cancelling the storage of Your payment credentials

You may withdraw Your consent to the storage of Your payment credentials, and remove any saved card, at any time, free of charge. This is done by You within Your member dashboard, where each saved card is listed together with the option to remove it. You may alternatively request removal by contacting Us at support@Skins.com, and We shall action any such request without undue delay.

Upon removal, the saved card ceases to be available for One-Click Payments and We instruct the deletion of the corresponding Stored Credential. You will be required to enter Your card details again should You wish to use that card in future. Removal does not cancel or reverse any payment already made, and has no effect on Your balance, Your items, Your open Buy Orders or Your account.

8.6. Retention and expiry of Stored Credentials

A Stored Credential is deleted where You remove the saved card, where You withdraw Your consent, upon closure of Your account under section 20, or where the underlying card has expired. Records of transactions already carried out are retained in accordance with Our Privacy Policy and applicable law, including anti-money-laundering and taxation requirements, but such records cannot be used to initiate any payment.

9. PAYOUTS

9.1. Supplier payouts

Supplier payouts are processed 7 days following confirmed delivery of the item to a Buyer in order to allow the transaction to be confirmed and any related matter to be addressed. We reserve the right to extend this period in respect of high-value items, newly created accounts, or any transaction under review.

9.2. Instant Payouts

Where instant payout processing is available, requests are processed on an accelerated basis. Instant processing is not guaranteed and may be subject to verification or delay.

9.3. Nature of payouts

A payout represents the remittance to a Supplier of the sale proceeds owed in respect of completed transactions, processed by Our payments agent. A payout is made only from the proceeds of a completed sale. Funds added by a User under section 8 do not constitute sale proceeds, are not payable by way of payout, and are applied towards purchases on Skins.com in accordance with section 8. Payouts are not escrowed funds, custodial holdings, or User-held deposits.

10. FEES AND PRICING

The Marketplace operates at 0% commission. We may levy fees in respect of particular services, including instant processing and the non-completion charges (section 3.4). Any applicable fees are displayed to the User before the relevant transaction is confirmed. Prices may be inclusive of VAT. Any change to fees is notified in section 21.

Fees and charges are non-refundable where the related service has been provided as described. Where a transaction is refunded because of non-delivery, misrepresentation, duplicate or unauthorised charging, or a platform or payment error, any associated fees are refunded with it. A refund of a purchase is returned to the original method of payment.

11. ACCEPTABLE USE

Skins.com depends on the fair and lawful conduct of its Users. Accordingly, You agree that You will not:

list or sell any item that is stolen, unlawfully obtained or that You are not entitled to sell;
use the Service to engage in any fraudulent or deceptive activity;
Misuse the payment, refund or dispute process, including by making a claim You know to be false;
Use bots, scrapers or other automated tools, save for those We provide or expressly permit;
Circumvent any geographic restriction or account-verification measure;
Interfere with the operation, security or infrastructure or the platform; or
Breach the rules of any connected third-party platform, including but not limited to Steam.

Where a User does not comply with this section 11, We may suspend or close the relevant account, cancel any affected transaction, or pursue any other remedy available to Us. Raising a good-faith dispute or refund claim, whether with Us or with Your card issuer or payment provider, is not a breach of this section.

12. DISPUTES AND REFUNDS

A Buyer should report any issue as soon as possible, and ideally within 7 days of the relevant transaction, so that third-party trade records remain available. This is a service target and does not limit Your statutory rights or Your right to raise a dispute with Your card issuer. A Supplier may dispute a payout decision by contacting support. Flyberry Ltd, as payment agent, is responsible for transaction disputes and refund decisions, and will assess disputes and refund claims against the criteria set out in Our Refund Policy and applicable consumer law, and may reverse a transaction or issue a refund accordingly. The User shall cooperate with any reasonable request for information made in connection with the resolution of a dispute.

13. THIRD-PARTY SERVICES

Skins.com operates in conjunction with third-party services, such as Steam, payment providers and identity verification providers. We shall not be responsible for any outage, policy change or action taken by such a service. Restrictions or technical limitations imposed by third party providers are outside of Our control. Skins.com is operated independently and is not affiliated with, endorsed by, or sponsored by Valve Corporation, CS:GO, CS2 and Steam are trademarks of their respective owners.

14. AVAILABILITY OF THE SERVICE

14.1. We reserve the right to modify, suspend or discontinue any part of the Service at any time. We shall not be liable for any interruption to the Service, save that We remain responsible for the repayment of any outstanding balance owed to a User.

14.2. We shall not be liable for any failure or delay in performance caused by events beyond Our reasonable control, including the acts or outages of Steam or other third parties, network or infrastructure failures, regulatory action, or any event of force majeure.

15. LIMITATION OF LIABILITY

15.1. To the maximum extent permitted by law, We shall not be liable for any indirect or consequential loss, loss of profit, loss of data, failure of any third-party platform, or loss arising from the User’s own acts and omissions.

15.2. To the maximum extent permitted by law, Our total aggregate liability to a User shall be the greater of USD 100 or the total fees paid by that User during the preceding 12 months. This limitation does not apply to any outstanding balance owed to the User, nor to any refund due under Our Refund Policy.

15.3. The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, We make no warranty that the Service will be uninterrupted, error-free or secure, and We are not liable for any loss arising from Steam or other third-party platform, from hardware, software or internet failures, or from any unathorised use of Your account by a person using Your credentials.

15.4. Nothing in these Terms limits or excludes any liability which cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any mandatory statutory right of a consumer.

16. INDEMNITY

The User shall indemnify Us against any claim, loss or cost arising from the User’s breach of these Terms, any unlawful conduct by the User, or any misuse of the User’s Steam or third-party account.

17. GOVERNING LAW

These Terms are governed by the laws of Hong Kong SAR. Nothing in this section deprives a consumer of the protection afforded by mandatory provisions of the law of the country in which they are habitually resident, or of the right to bring proceedings in the courts of that country where applicable law so provides.

Before commencing formal proceedings, the parties shall first attempt in good faith to resolve any dispute through negotiation for a period of at least 30 days following written notice. Any dispute not resolved within that period shall be subject to the exclusive jurisdiction of the courts of the Hong Kong SAR, subject always to the preceding paragraph.

18. DATA PROTECTION

We process personal data in accordance with applicable data protection laws, including EU General Data Protection regulation (GDPR) where applicable. Our collection and use of personal data is described in Our Privacy Policy, which forms part of these Terms and is available on the platform. We process personal data for the purposes of providing the Services, verifying identity, complying with legal and regulatory obligation, and preventing fraud and abuse.

19. COMPLAINTS

Should You wish to make a complaint, You may contact Us using the details set out in section 22. We shall acknowledge and seek to resolve complaints within a reasonable period. Nothing in these Terms affects any mandatory rights You may have under the consumer protection law of Your country of residence.

20. ACCOUNT CLOSURE AND DORMANT BALANCES

You may close Your account at any time. We may close or suspend an account in accordance with these Terms, including in the event of breach, suspected fraud, or for regulatory reasons. Upon closure, any remaining balance shall be dealt with in accordance with section 9 and applicable law, subject to any verification We are required to undertake. Where the remaining balance includes fiat funds added under section 8 which have not been applied to purchases, those funds are returned to the original method of payment, and the spend condition in section 8.3 does not apply to that return. When an account shows no activity for a period of 12 months, We may apply a dormancy process, including taking reasonable steps to contact You and to deal with any remaining balance in accordance with applicable law.

21. AMENDMENTS

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Any changes take effect as soon as they are published on the Website. We recommend that you review the Terms regularly to stay informed. If we make any material changes that significantly impact your rights or obligations, we will provide notice where required by law. If you continue to use the Services after changes are published, you are considered to have accepted the updated Terms. If you do not agree to the revised Terms, you must stop using the Services. These Terms are published in English and may be translated into other languages. In the event of any conflict between the English language version and a translated version, the English version shall prevail.
